Trade and freight debt recovery in Germany

By Chidi Okafor, Counsel, Trade Practice · Published · Updated

A German buyer or freight partner has stopped paying on invoices tied to delivered cargo, and the file has sat unresolved for weeks. Trade freight debt recovery in Germany only works if the claim, the paperwork and the debtor's position are assessed before any letter goes out. We say so before we say anything else.

How the recovery process runs in Germany

German commercial claims tied to trade or freight follow a defined sequence rather than a single letter. A documented demand states the sum, the underlying contract and a deadline for payment. If the debtor stays silent or disputes without substance, the file moves toward a licensed collection step, and only then toward litigation before the competent German court. This sequence is one strand of our wider work in trade and freight debt recovery across borders, applied here to German procedure and German courts.

Each stage ends with a decision for the client, not an automatic escalation. After the demand, the client decides whether to accept a payment arrangement, refer the file for collection, or move straight to litigation if the amount and the paperwork justify it. After a court order, the client decides whether to enforce inside Germany or pursue assets that have already moved abroad.

What decides the outcome

German courts decide on documents, not on an account of what was agreed by phone. The consignment note, the purchase order, the delivery confirmation and any written acknowledgement of the debt carry more weight than the strength of the underlying commercial relationship. A debtor who disputes quality, quantity or delivery timing shifts the file from a straightforward debt claim into a factual dispute, and that changes both the route and the likely duration.

A German judgment does not travel automatically once the debtor's assets sit outside the country, and the reverse is also true. Recognition and enforcement of a foreign judgment in Germany follow a separate procedure from the underlying claim. We check where the debtor actually holds assets before advising on the forum, not after a judgment has already been obtained.

The licensing position in Germany

Our work on the debtor's commercial position rests on legal research and corporate intelligence from public and licensed sources. Pre-legal collection is a regulated activity in Germany, and that step is carried out by a registered provider licensed for the purpose. SOLUTIO does not carry out that step directly.

This licensing position sits inside the wider framework for debt recovery in Germany, which sets out the court structure, the standard defences and the realistic sequence in outline. None of it changes the stages described above; it explains why each stage is handled by the party licensed to handle it.

Our role and the role of the local provider

SOLUTIO assesses the claim, decides whether pursuit is worthwhile, and instructs the licensed provider or the admitted German lawyer who carries out the next step. The fee basis is agreed with the client in writing before instruction, and it is not structured as a fee consisting solely of a share of any amount recovered.

For a claim where the debtor's financial position is unclear, the work often starts with a debtor due diligence report rather than a demand letter, so the client decides on facts rather than on assumption.

When this is not worth doing

  • The invoice is disputed on genuine grounds and no documentation supports the client's account of the contract.
  • The debtor has ceased trading or shows signs of insolvency, and no realisable asset sits in Germany or elsewhere.
  • The amount owed does not justify the cost of the route once the fee basis and the likely defences are set out plainly.
  • The claim depends on evidence the client cannot produce, such as a signed delivery note or a written acknowledgement of the debt.

Common questions

How long does a freight debt claim take to resolve in Germany?

The duration depends on whether the debtor disputes the claim on substance or stays silent. A silent debtor with clear documentation moves faster than a debtor who contests delivery or quality. We give a realistic sequence once the file has been reviewed, rather than a fixed estimate in advance.

Can we enforce a foreign judgment against a German debtor directly?

A foreign judgment against a German debtor is recognised and enforced through its own procedure, separate from the original claim. The route depends on where the judgment was obtained and what the debtor holds inside Germany. We assess this before recommending a forum for a new claim.

Do you handle the pre-legal collection step yourselves?

No. Pre-legal collection is a regulated activity in Germany, and that step is carried out by a registered provider licensed for the purpose. SOLUTIO assesses the claim, decides on the route and instructs that provider or the German lawyer where litigation is the better path.

Freight and cargo claims lose value while a file sits unassessed, because a debtor's assets and the goods themselves can move before a claim is filed. A competing creditor who files first often reaches the same limited assets ahead of a claimant who spent that time deciding. The choice between a demand, a licensed collection step and litigation is easier to make once the position has been assessed than after a route has already been chosen.
